Widerruf und Widerrufsfolgen

Das Recht auf Widerruf (Abs. 8.1 bis 8.5) steht dem Käufer nur zu
wenn er eine natürliche Person ist und die Ware ausschließlich zu privaten Zwecken bestellt. Wenn die Ware einer selbständigen beruflichen Tätigkeit zugerechnet werden kann oder zu gewerblichen Zwecken bestellt wird

312d Abs. 2 BGB. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache. Der Widerruf ist zu richten an:

b) Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Kann der Kunde die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren
muss der Kunde
dem Verkäufer insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht

c) Paketversandfähige Sachen sind auf unsere Kosten und Gefahr zurückzusenden. Nicht paketversandfähige Sachen werden beim Kunden Ihnen abgeholt. Der Kunde ist verpflichtet
die Ware vollständig mit sämtlichen mitgelieferten Dokumentationen und Zubehörteilen in der Originalverpackung zurückzusenden. Sendet der Kunde ihm mitgelieferte Dokumentationen und Zubehörteile nicht mit
stellt dies eine Verschlechterung der Ware gem. Ziffer 8.2 dar
für die der Kunde Wertersatz leisten muss.

d) Software kann nur in versiegeltem Zustand widerrufen werden.

e) Das Widerrufsrecht erlischt vorzeitig
wenn der Webseitebetreiber mit der Ausführung der Dienstleistung mit der ausdrücklichen Zustimmung des Kunden vor Ende der Widerrufsfrist begonnen hat oder der Kunde diese selbst veranlasst hat (z. B. durch Download
